1. Introduction & Acceptance

Welcome to CiteRadar ("we", "our", or "us"). By accessing or using our AI visibility tracking service at citeradar.com (the "Service"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use our Service. By creating an account or using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Age Requirement: You must be at least 16 years old to use our Service. By using the Service, you represent that you meet this requirement.

2. Service Description

CiteRadar is an AI visibility tracking platform that helps businesses monitor how they are mentioned and cited in AI model outputs. Our Service includes:

• Brand Monitoring: Track how AI models mention your brand and competitors
• Query Analysis: Create custom queries to monitor specific topics
• Visibility Scoring: Quantified metrics showing your AI presence
• AI Insights: Automated analysis and recommendations

Important: Our Service only analyzes public AI model outputs. We do NOT access your customer data, CRM systems, website visitor information, or any private business data.

3. Account Registration & Security

3.1. Account Creation

To use most features of our Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account

3.2. Account Responsibility

You are responsible for all activities that occur under your account. You may not share your account credentials with others or allow others to access your account.

3.3. Organizations

Accounts can create or join organizations. Organization owners have administrative control and can invite team members with different permission levels (Admin, Member, Viewer).

4. Subscription & Payment Terms

4.1. Free Trial

New users receive a 14-day free trial with no credit card required. During the trial, you have access to limited features to evaluate our Service.

4.2. Subscription Plans

We offer the following paid plans (prices in EUR, billed monthly):

• Starter (€99/month): 5 domains, 25 queries, 500 snapshots/month
• Growth (€199/month): 15 domains, 100 queries, 2,000 snapshots/month
• Enterprise: Custom pricing for larger needs

4.3. Billing

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

4.4. Cancellation & Refunds

• You can cancel your subscription at any time from your settings
• Cancellation takes effect at the end of your current billing period
• Refunds may be provided within 30 days of purchase for annual plans at our discretion
• No partial refunds are provided for unused portions of monthly subscriptions

5. Acceptable Use Policy

5.1. Permitted Use

You may use our Service only for lawful purposes and in accordance with these Terms.

5.2. Prohibited Activities

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or extract source code from our Service
• Use automated scripts or bots to access the Service beyond our provided APIs
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity or misrepresent your affiliation
• Resell or redistribute the Service without our written consent
• Use the Service to harm, abuse, or harass others
• Violate any applicable laws or regulations

5.3. Rate Limits & Fair Usage

Each plan has usage limits (domains, queries, snapshots). Exceeding these limits may result in restricted access until the next billing cycle or an upgrade to a higher plan.

6. Intellectual Property

6.1. Our Property

CiteRadar, including its design, code, logos, trademarks, and all content provided by us, is our exclusive property or licensed to us. You may not copy, modify, or distribute any part of our Service without permission.

6.2. Your Content

You retain ownership of any data, queries, or configurations you create within the Service. By using our Service, you grant us a limited license to use this content solely to provide and improve the Service.

6.3. AI-Generated Content

The AI responses and insights provided by our Service are generated by third-party AI models. You acknowledge that this content may not always be accurate and should not be relied upon as the sole basis for business decisions.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

7.1. GDPR Compliance

We comply with the EU General Data Protection Regulation (GDPR). You have the right to:

• Access: Export all your data via settings or API
• Deletion: Delete your account and all associated data
• Portability: Download your data in CSV format
• Rectification: Update your account information
• Object: Opt out of non-essential communications

8. Third-Party Services

Our Service integrates with third-party AI providers and services. By using our Service, you acknowledge that:

• EU-Hosted (Default for EU users):
  • Azure OpenAI (Netherlands) - GPT-4o, GPT-4o-mini
  • Google Vertex AI (Belgium) - Gemini 1.5 Flash, Gemini 1.5 Pro
• US-Based (with Standard Contractual Clauses):
  • Anthropic Claude - Claude 3.5 Sonnet, Claude 3 Haiku
  • Perplexity - Sonar models (automatically disabled for EU users)

All AI providers are configured with zero data retention mode. We only send query prompts and domain names - never personal information.

8.2. Infrastructure Providers

• Database: Railway (EU)
• File Storage: Cloudflare R2 (EU)
• Cache: Upstash (EU)
• Email: Resend (EU - Ireland)
• Payments: Stripe (EU + US)

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of AI-generated content
• Uninterrupted or error-free operation
• Availability of third-party AI models (which may change or be discontinued)

We do not guarantee that the visibility scores, rankings, or insights provided will result in any specific business outcomes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CITERADAR SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from third-party AI model outputs
• Service interruptions or data loss beyond our reasonable control

Our total liability shall not exceed the amounts you paid to us in the 12 months preceding the claim.

11. Termination

11.1. By You

• Cancel your subscription at any time from settings
• Delete your account, which immediately removes your personal data
• Delete your organization (30-day grace period before permanent deletion)

11.2. By Us

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in prohibited activities
• Fail to pay subscription fees
• Pose a security risk to our Service or other users

We will provide reasonable notice when possible, except in cases of immediate security threats.

12. Dispute Resolution

12.1. Governing Law

These Terms are governed by the laws of Austria, without regard to conflict of law principles.

12.2. Jurisdiction

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Austria.

12.3. Informal Resolution

Before filing any formal legal action, you agree to contact us at [email protected] to attempt informal resolution.

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top
• Notify you via email (for registered users) at least 14 days before changes take effect
• Post a notice on our website

Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
